1. Acceptance of Terms

By accessing or using Spottr ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Spottr is a fitness application that uses AI-powered video analysis to provide feedback on your workout form. The App allows you to record exercise videos, receive form analysis, and track your fitness progress.

3. User Accounts

To use Spottr, you must:

• Create an account with accurate information
• Be at least 13 years of age
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account

4. User Content

When you upload content (including workout videos) to Spottr:

• You retain ownership of your content
• You grant us a license to process, store, and analyze your content to provide our services
• You are responsible for ensuring you have the right to upload the content
• You agree not to upload inappropriate, illegal, or harmful content

5. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Upload malicious code or content
• Impersonate others or misrepresent your affiliation

6. Health Disclaimer

Important: Spottr provides fitness form feedback for informational purposes only. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider or certified fitness professional before starting any exercise program. Use the App at your own risk and within your physical capabilities.

7. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by Spottr and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

8. Limitation of Liability

To the maximum extent permitted by law, Spottr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or other damages arising from your use of the App.

9. Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting the updated terms in the App or via email. Continued use of the App after changes constitutes acceptance of the new terms.

11. In-App Subscriptions

Spottr offers optional paid subscriptions ("Spottr Pro") that provide additional features beyond the free tier.

• Plans: Spottr Pro is available as a monthly or annual subscription. Current pricing is displayed in the app before purchase.
• Billing: Payment is charged to your Apple ID account at the time of purchase confirmation.
• Auto-Renewal: Your subscription automatically renews at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period.
• Cancellation:You can cancel your subscription at any time through your device's Settings > [Your Name] > Subscriptions > Spottr. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then.
• Refunds: Refunds are handled by Apple in accordance with their refund policies. Spottr does not directly process refunds for App Store purchases.
• Price Changes: We may change subscription pricing at any time. Any price changes will take effect at the start of your next billing period, and you will be notified in advance by Apple.

12. AI-Powered Analysis & Third-Party Data Processing

Spottr uses artificial intelligence to analyze your exercise form. By agreeing to use this feature:

• You consent to selected video frames and pose data from your recordings being sent to Google via the Gemini API for analysis.
• Google processes this data in accordance with their Gemini API Terms of Service. Your data is not used for AI model training.
• You may delete your data at any time from the Settings screen in the app, or by deleting your account entirely.
• AI analysis results are provided for informational purposes only and should not be considered professional fitness or medical advice.
